DEFINITIONS
The following words have the following meanings:
BANQUET: Any function, event, meeting, reception, conducted on the premises of the restaurant and subject to the terms of this agreement.
PATRON: The customer, person, corporation, entity organization or association contracting with the restaurant for a banquet.
RESTAURANT: The Kowloon Restaurant
TAXES: All state, federal, municipal and other taxes imposed on or applicable to the banquet which is subject to this agreement are payable by the Patron in addition to any and all other charges set forth elsewhere.
GUARANTEE: At least one week prior to the banquet, the Patron shall specify to the Restaurant the exact number of persons to be in attendance. Said number shall constitute a guarantee minimum and the Patron shall be charged for at least said minimum. The Patron may increase the minimum within forty-eight (48) hours of the date of the banquet. MINIMUM GUARANTY FIFTY PEOPLE.
PAYMENT IN ADVANCE: Full payment for all banquets must be made in cash, certified check or major credit card at least three (3) days prior to the date of the banquet unless otherwise agreed upon at the time of the booking.
DEPOSIT POLICY: A deposit of at least one hundred (100) dollars at the time of the booking for each banquet. In the event of cancellation of this agreement by the Patron or in the event of cancellation of this agreement for cause by the Restaurant, the Restaurant shall retain as liquidated damages the entire amount of any deposit.
COMPENSATION: The patron agrees that an amount equal to $85 per wait staff charge will be added to the account which will be distributed to waitresses, waiters and bar tenders; an additional $85 will be distributed to the administration.
PRICE INCREASES: Prices are subject to change without notice. The patron agrees to pay such increases.
NON-PERFORMANCE: If for any reason beyond its control, including but not limited to labor disputes, strikes, accidents, acts of war or acts of

God, the Restaurant is unable to perform its obligations under this agreement, such non-performance shall be excused and the Restaurant may terminate this agreement without liability upon the return of the Patron's deposit. In no event shall the Restaurant be liable for consequential damages of any nature for any reason whatsoever. If for any reason the space reserved hereunder is not available for the banquet, the Restaurant may substitute therefore other space at least comparable in quality thereto and Patron agrees to accept such substitutions.
BEVERAGES: The Patron shall not bring any beverages of any kind onto the Restaurant premises from off premises nor permit any of its invitees or guests to bring beverages of any kind from off premises.
DECORATIONS AND DISPLAYS: All decorations and displays of any kind whatsoever shall not be displayed without the prior approval of the Restaurant and then only in a manner approved by the restaurant.
SECURITY: The Restaurant may at its so option require the Patron to maintain adequate security measures for any banquet. Said Security shall be maintained by the Patron at its sole expense. All security shall be supplied by Saugus Police Department.
CONDUCT OF BANQUET: Patron agrees that the banquet will be conducted in an orderly manner and in full compliance with all applicable laws, regulations and reasonable Restaurant rules. The patron hereby agrees to indemnity and hold harmless the Restaurant against any and all claims for personal injury, property damages and losses arising out of or connected with the banquet or this agreement caused or contributed to by the negligence a Patron or any guest, invitee or agent of the Patron or any one hired by said Patron. Further, the Restaurant or any of its officers, employees, agents, or other representatives shall not be held responsible, accountable or liable for, and the same hereby released from accountability for any damage, loss, harm or injury to the Patron or any property of the Patron or any of its officers, agents, employees or other representatives, resulting from theft, fire, water, accident or other causes.
